ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your access to and use of the BUHZD website (buhzd.com), mobile site, and any related products, services, or features offered (collectively, the "Services"). The Services are operated by BUHZD ("Company," "we," "us," or "our").

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.

AGE RESTRICTION

YOU MUST BE AT LEAST 21 YEARS OLD TO USE THIS WEBSITE AND PURCHASE PRODUCTS.

By accessing or using the Services, you affirm that you are at least twenty-one (21) years of age, the legal drinking age in the United States. Alcoholic beverages can only be purchased by and delivered to individuals aged twenty-one (21) or older.

Upon delivery, a valid government-issued photo ID verifying age will be required. The recipient must be sober and at least 21 years of age. All products are intended solely for legal, personal use and not for resale.

If you allow any individuals under the age of twenty-one (21) to access or use the Services, you shall be solely responsible for their use and shall indemnify us against any losses, claims, or damages that may result.

ACCOUNT REGISTRATION

If you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You may only create and maintain one (1) account for personal use of the Services.

PRODUCT AVAILABILITY AND PRICING

All products listed on the website are subject to availability. We strive to ensure accurate pricing and product information. In the event of an error in pricing or product details, including typographical and photographic errors, we reserve the right to correct such errors and, if necessary, refuse or cancel orders affected by them.

Prices and promotions are subject to change without notice. Some items, especially limited-quantity or allocated products, may not be available in the quantities indicated.

We reserve the right to limit quantities purchased per person, per household, or per order.

SHIPPING AND DELIVERY

Shipping Availability

We currently ship to the following states: California, Arizona, Nevada, Texas, Colorado, New Mexico, Oregon, Washington, and Idaho. Shipping availability is subject to change based on applicable laws and licensing requirements.

Age Verification at Delivery

An adult signature is required for all deliveries. The person receiving the shipment must:

• Be at least 21 years of age
• Present a valid government-issued photo ID
• Be sober at the time of delivery

If these conditions are not met, the delivery driver will not release the package.

Shipping Responsibility

By placing an order, you represent that you:

• Are legally entitled to receive alcoholic beverages in your state
• Have complied with all applicable state and local laws
• Authorize us to arrange transportation and delivery on your behalf

You are responsible for abiding by all state and local laws pertaining to the receipt of alcoholic beverages.

RETURNS AND REFUNDS

Due to the nature of alcoholic beverages, we can only accept returns for:

• Damaged products (reported within 48 hours of delivery with photos)
• Incorrect items shipped
• Products that are spoiled or otherwise unfit for consumption

To request a return, contact us at support@buhzd.com within 48 hours of receiving your order. Refunds will be processed to the original payment method within 5-10 business days after we receive and inspect the returned product.

We cannot accept returns for:

• Products that have been opened
• Products refused at delivery due to failed age verification
• Change of mind or buyer's remorse
• Products shipped to incorrect addresses provided by the customer

INTELLECTUAL PROPERTY

All content on the Services, including text, graphics, logos, images, and software, is the property of BUHZD or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content without our prior written consent.

PROHIBITED CONDUCT

When using the Services, you may NOT:

• Violate any applicable laws or regulations
• Misrepresent your identity or age
• Purchase products for resale
• Purchase products for anyone under 21 years of age
• Use the Services for any fraudulent or illegal purpose
• Interfere with or disrupt the Services
• Attempt to gain unauthorized access to any systems
• Use automated tools to scrape or collect data

DISCLAIMER OF WARRANTIES

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUHZD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, or the like that may be transmitted through the Services
• Any errors or omissions in any content

Our total liability shall not exceed the amount you paid for the products giving rise to the claim.

INDEMNIFICATION

You agree to indemnify and hold harmless BUHZD, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws regarding the purchase, transportation, and delivery of alcoholic beverages

DISPUTE RESOLUTION AND ARBITRATION

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Exceptions

This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

TERMINATION

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms.

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
